Welcome to The Scoop (thescoop.guide). The site is operated by Wilsonconsulting.co LLC, doing business as The Scoop ("The Scoop," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the site. By using the site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site.

Who can use the site

The site is intended for users who are at least 18 years old, or the age of majority where they live. By using it you represent that you meet that requirement and that any information you give us is accurate.

What The Scoop is, and is not

The Scoop publishes editorial guides that rank and review local businesses by category and city. Our rankings, descriptions, and "best of" selections are statements of opinion, formed in good faith from our analysis of publicly available reviews and other signals, plus human editorial judgment, as of the date each guide is published or updated. Reasonable people can disagree with an opinion, and ours is not a statement of objective fact about any business.

The Scoop is not a directory, a broker, an agent, or a party to any transaction between you and a business. We do not provide professional, legal, medical, financial, or home-repair advice, and nothing on the site is a guarantee about any business's quality, licensing, insurance, pricing, availability, or suitability for your needs. Always do your own diligence and verify details directly with a business before hiring or buying.

Partner businesses

Some businesses pay to participate in The Scoop's partner program. A Partner relationship is a paid commercial relationship that is clearly and conspicuously labeled wherever it appears. Two things are always true about it. First, a business is only eligible to be a Partner if it independently meets our editorial quality standards, so we never recommend a business that has not earned a place on the merits. Second, our underlying editorial assessment of each business, including its ranking and what we write about it, is made independently of whether it pays, and a partnership never changes a ranking. We disclose these paid relationships consistent with FTC guidance on endorsements and advertising. See How We Pick and our About page for the details.

Business information and third-party content

Guides include factual information about businesses (such as name, address, phone, hours, and price level) drawn from public sources, along with short excerpts and summaries of third-party customer reviews. Business names, logos, and trademarks belong to their respective owners and are used for identification and commentary (nominative fair use). Review excerpts reflect the views of the people who wrote them, not The Scoop. We make reasonable efforts to be accurate but do not warrant that third-party information is complete, current, or error-free.

If you are a business owner

If your business appears in a guide and you believe something is inaccurate, out of date, or should be corrected or removed, contact us and we will review the request promptly. Inclusion in a guide is editorial and does not require your participation; a partnership is optional and separate.

Submissions you send us

If you send us a tip, correction, comment, or other content (for example, through our contact form), you grant The Scoop a non-exclusive, royalty-free, worldwide license to use it to operate and improve the site. Do not send confidential information or anything you do not have the right to share, and make sure what you send is truthful.

Acceptable use

You agree not to misuse the site, including by: scraping or harvesting content at scale, attempting to gain unauthorized access, interfering with the site's operation, using it to harass a business or person, or republishing our content in a way these Terms do not allow.

Our content and your license to use it

The site's editorial content, design, and compilation belong to Wilsonconsulting.co LLC and are protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable license to view the site for your own use. You may quote a short excerpt with attribution and a link, but you may not copy, republish, or redistribute our content wholesale, or use it to train models or build a competing product, without our written permission.

Third-party links

The site links to third-party websites (such as business websites and booking pages). We do not control and are not responsible for those sites or their content, and a link is not an endorsement.

Disclaimers

The site and all content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free, or that any business will meet your expectations. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

Limitation of liability

To the maximum extent permitted by law, The Scoop, Wilsonconsulting.co LLC, and its owners, members, officers, editors, and contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the site or from your dealings with any business listed on it. To the maximum extent permitted by law, our total liability for any claim relating to the site will not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Indemnification

You agree to indemnify and hold harmless The Scoop, Wilsonconsulting.co LLC, and its owners, members, officers, editors, and contributors from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the site or your violation of these Terms.

Copyright complaints

If you believe content on the site infringes your copyright, send a notice with enough detail to identify the work and the material, your contact information, and a good-faith statement, to hello@thescoop.guide or through our contact page. We respond to valid notices consistent with the Digital Millennium Copyright Act.

Binding arbitration and class-action waiver

Please read this section carefully, because it affects your legal rights. Except for the informal-resolution step below, and except where prohibited by law, you and The Scoop agree that any dispute, claim, or controversy arising out of or relating to the site or these Terms will be resolved by final and binding individual arbitration, administered by a recognized arbitration provider under its consumer arbitration rules, rather than in court. There is no judge or jury in arbitration, and review is limited.

You and The Scoop each waive any right to a jury trial and any right to bring or participate in a class, collective, consolidated, or representative action. Arbitration will proceed only on an individual basis. If the class-action waiver in this paragraph is found unenforceable as to a particular claim, that claim, and only that claim, will be severed and proceed in court, and the rest of this section still applies.

You may opt out of this arbitration agreement by sending us notice at hello@thescoop.guide within 30 days of first accepting these Terms. If you opt out, the Governing law and disputes section below applies to you instead.

Time limit on claims

To the extent permitted by law, any claim arising out of or relating to the site or these Terms must be filed within one (1) year after the claim arose; otherwise it is permanently barred.

Governing law and disputes

The Scoop publishes guides for cities across the United States, but it is operated from a single home state, and these Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules, no matter which city's guide you read or where you live. Before filing anything, you agree to first contact us at hello@thescoop.guide and try to resolve the matter informally for at least 30 days. For any dispute not subject to arbitration above (including if you opted out, or for a claim that proceeds in court), you and The Scoop consent to the exclusive jurisdiction and venue of the state and federal courts located in Jefferson County, Colorado.

Changes to these Terms

We may update these Terms from time to time. The date above always reflects the current revision, and your continued use of the site after a change means you accept the updated Terms.

Severability and entire agreement

If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms, together with our Privacy Policy, are the entire agreement between you and The Scoop regarding the site. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms; we may.
